MEMORANDUM OF DECISION

On March 30, 1994, I entered an order granting Maine Savings Bank’s unopposed motion for relief from stay. This memorandum spells out the basis for my decision.
The facts are not in dispute. The Strickfords are the owners of four parcels of real property on North Browns Island in the Penobscot River in Machias, Maine. Each of these properties, together with all monies accumulated in connection with the properties, is secured by a mortgage on the property and deeds of trust on the rental income from the properties.
In September, 1991, the Strickfords began diverting water from the Penobscot River to certain baldcypress trees on their land. The water is released during times of low tide to provide a microclimate in which the trees can flower. In July, 1992, James Strickford applied for a permit to construct a stream channel behind two of the lots, and another stream channel in a third property. The stream was to divert spring run-off from a portion of North Browns Island and from owned property in the adjoining tidal basin. A permit was issued on August 26, 1992.
The Strickfords paid the $1,500 permit fee. Maine Law does not impose a licensing or permit requirement for the acquisition or use of water or the diversion thereof. Title to the diverted water, however, vest in the outgoing water once it passes beyond the right of way. Home Water Co. v. Davis, 304 F.2d 509 (5th Cir.1962

• Fight Monsters and Collect the Scattered Shards of History
Throughout the Lands Between, the scattered remains of history, such as the Standing Stone of the Warforged, the Temple of the Divine Mummy, the Forest of the Magical Growths, and the Scattered Ruins of the Grand Vizier’s Haven, form the backstory of an epic drama. These fragments of history are scattered across the land, and finding them will be the main factor behind your survival in the Legendary Lands.

Once you combine the pieces of history scattered throughout the lands with your character and convenience items to create the Girdle of the Light and the Abyss of Life, the epic fantasy story will be resolved. Once the conflict has been resolved, your efforts will have been rewarded.
